The City of Madrid passed decree-law 79/2014 to regulate short-term rentals. Our Hosts must abide by these requirements and the buildings and safety standards. This page is only designed to give you an overview of the local requirements, but it is the host duty to know the legislation and to comply with the local laws. misterb&b is not a legal adviser : you should have a look at the relevant laws and contact the local authorities or a local professional for further understanding.


Definition of viviendas de uso turistico

Under the local laws, viviendas de uso turistico are recognized as any dwelling units, furnished and equipped for immediate use, that is fully transferred by their owners to a third party for touristic use, in exchange for money. It concerns every type of accommodations (flat, studio, bungalow, townhouse, villa) as long as it is rented entirely.



Before starting your rental activity, you must submit a Declaracion responsable para el inicio de la actividad de vivienda de uso turístico to one of the government administration office, or online if you have an electronic signature (certificado electrónico).

After the submission of the Declaration form, the rental unit must be registered to the Registro de Empresas Turísticas de la Dirección General. More information can be found about this process on the website of the Comunidad de Madrid. The property will be attributed a registration number that must be displayed on the misterb&b listing. To do so, when connected on your misterb&b account, you have to click on edit my listing” > “address.


Occupancy standards

Rental units in Madrid should respect some minimum standards, listed in article 18 of the decree. Particularly, they should be fully furnished and equipped with a Wifi connection. If, the unit you want to rent is a studio accommodation, sleeping arrangements should be available in the living area for a minimum of two guests.

Guests should be given a telephone number on which they could contact the Host or another local person anytime in case of emergency.

On the front-door of your place must be displayed a distinctive board (according to the model in the Annex IV of the decree 79/2014).


Services price

Please mind that the price of all the services provided to the guests must be clearly displayed at the entrance of the rental. However, note that the charges for water, energy, air-conditioning, bed sheets, towels and cleanings should be included into the rental price.


Security laws

All Guests are required to fill in a registration form (parte de entrada) provided by the Host, at the check-in. A copy of each filled-in registration form must be communicated to the Police for every Guest over 16 years old (it can be done online). The originals must be kept by the Hosts for 3 years.
