On September 1, 2022, the Tourist Accommodation Act entered into effect. It creates new requirements for STRs in Quebec. Applicable taxes
Your hosting activity may be subject to various taxes. misterb&b registered with Revenue Québec to collect and remit on your behalf the lodging and State/provincial sales taxes. For more information, check our FAQ about sales/lodging tax collection in Canada.
You remain responsible for registering for, collecting and/or remitting any other taxes applicable to your hosting activity.
Tourist accommodations establishments
According to local law, a "tourist accommodation establishment" is a lodging where at least one accommodation unit (such as a bed, room, suite, apartment, house, cottage, ready-to-camp unit or campsite), is offered for rent, for consideration, to tourists for a period not exceeding 31 days.
There are 3 types of tourist accommodation establishments:
- Principal residence establishment: when you Hosts Guests at your own residence.
- Youth tourist accommodation establishment: establishments in which at least 30% of accommodation units consist of beds in one or more dormitories, or where accommodation is mainly offered as part of activities intended primarily for underprivileged individuals or individuals who have a disability.
- General tourist accommodation establishment: other than principal residence establishments and youth tourist accommodation establishments.
Tourist accommodations registration
It is mandatory to register all tourist accommodations. You do not have to register if you only rent your accommodation for long-term (32 days or more).
- Municipal Compliance. First you have to obtain a notice of compliance signed by your local municipal authorities. It will confirm that your tourist accommodation establishment is in line with local zoning and use regulations. For more information about this please check this official FAQ.
- Registration process. The registration application can be completed online here. For more information about the registration fees please visit this site.
- Renewal. The registration must be renewed annually, within the 60 days preceding the date of expiration of the certificate.
You must add the registration number (and a pdf copy of the registration certificate) to your misterb&b listing(s) (go to the “Local Requirements” page, via “Edit my listing”). In the absence of valid information, misterb&b may delete your listing.
Maintaining compliance
You must operate your tourist accommodations in full compliance with applicable City, Provincial and State laws. Special requirements may apply about, without limitation, design, maintenance standards, habitability, health, and safety standards and requirements.
- Insurance. According to local law, you should maintain civil liability insurance for at least $2,000,000 CAD per claim that covers bodily injury and property damage caused in the course of operation of the establishment.
- Display of certificate. You must display the registration certificate of the tourist accommodation establishment in full view of the public at the main entrance to the establishment.
Third-party rules
- Community rules. Verify that no lease agreements, homeowners’ association bylaws, covenants, conditions & restrictions (CC&Rs) or other prohibit the use of your unit as a STR;
- Lease contract. If you are a renter, you must make sure hosting Guests do not violate the lease.
Data-sharing and privacy
misterb&b is required by law to save and share some information with the province of Quebec. It includes the listing’s registration certificate number, and other personal information.
By using misterb&b, you consent to the collection, retention, use and disclosure of all information required by the Province (in accordance with all legal obligations and processes).
