This page is only designed to give you an overview of the local requirements, but it is the host duty to know the legislation and to comply with the local laws. misterb&b is not a legal adviser : you should have a look at the relevant laws and contact the local authorities or a local professional for further understanding.

The Zweckentfremdungsverbot law and its ordinance introduces a strict ban on short-term rentals of entire apartments without a city permit. Note that the City is willing to ensure the respect of this law : hosts being in violation of those laws might face harsh sanctions (fines up to € 100,000).

The permit must be requested at the Office of the District the apartment is located in. Other documents might be requested (like the landlord’s consent if the Host is a tenant) : a list can be found at the end of the permit’s application form.

You will be able to find the contacts of the competent authorities that can give you further details / to which you might apply for a permit here.

Our Hosts should mind that the rental units should comply with the building requirements. They may be subject to taxes for their rental activities : visit the official website of the City of Berlin to know more about this issue.

For more information about this new policy, see this page and this one on the official website of Berlin City.
