Definition

The ley 13/2016 de Turismo of July 28, 2016 divides the empresas turísticas de alojamiento between establecimientos de alojamiento, viviendas de uso turístico and habitaciones en vivienda de uso turístico. You may check the definitions to find out in which fits your rental.

  • Viviendas para uso turístico 

Defined by article 53 of Tourism law 3/2016 as “las viviendas, cualquiera que sea su tipología, que se ofrezcan o comercialicen como alojamiento por motivos turísticos o vacacionales, siendo cedidas temporalmente por la persona propietaria, explotadora o gestora y comercializadas directamente por ella misma o indirectamente, a terceros, de forma reiterada o habitual y a cambio de contraprestación económica, en condiciones de inmediata disponibilidad”. It includes apartamentos particulares, estudios, pisos, villas and chalets.

It is considered to be rented out on a regular basis (“de forma reiterada o habitual”) when the “vivienda” is rented out for 31 days or less twice or more in the same year ; or when it is advertised on any channel/medium of tourist offers.

The “viviendas para uso turístico” regime can not apply on “viviendas” rented out under the rules of Ley 29/1994, de 29 noviembre, de Arrendamientos Urbanos.

  • Habitaciones en vivienda particulares para uso turístico :

Habitaciones” in viviendas as defined in article 53. Article 54 precises that it only concerns bedrooms in an accommodation that constitutes the effective residence of the Hosts.

It is considered to be rented out on a regular basis (“de forma reiterada o habitual”) when the “habitacion” is rented out for 31 days or less twice or more in the same year ; or when it is advertised on any channel/medium of tourist offers.

The “habitaciones” regime can not apply on “habitaciones” rented out under the rules of Ley 29/1994, de 29 noviembre, de Arrendamientos Urbanos.

 

Declaración responsable de inicio de actividad turística

The ley 13/2016 de Turismo of July 28, 2016 requires, before beginning of activity, to present a Declaración responsable before the Administración turística de Euskadi.

Presenting the Declaración responsable de inicio de actividad turística has for effects to register the vivienda / habitación in the Registro de Empresas y Actividades Turísticas de Euskadi.  After registration, your unit will be issued a registration number, that must be entered on your misterb&b listing. To do so, when connected on your misterb&b account, go to “edit my listing” > “address”  .

 

Requirements / Standards

The “viviendas para uso turístico” and the “habitaciones para uso turístico” must comply with all the norms on urbanism, building, safety, environment, hygiene and more. The Hosts should not welcome more Guests than the authorized maximum, as defined in article 62.2 de la Ley 3/2015 de 18 de Junio, de Vivienda de Euskadi.

The Hosts must maintain a civil liability insurance.

 

Obligation of information

Hosts must share some informations with their Guests prior to the hosting. These informations includes, without limitation, the price of the booking, the characteristics of the services included in the price and the Registro de Empresas y Actividades Turísticas number. You can find a full list at article 32 of the Tourism law 13/2016. You can share those informations by posting it on your listings or  displaying it in your accommodation.

 

Security laws

All Guests are required to fill in a registration form (parte de entrada) provided by the Host, at the check-in. A copy of each filled-in registration form must be communicated to the Police for every Guest over 16 years old (it can be done online). The originals must be kept by the Hosts for 3 years.
