Typology of strutture ricettive

Legge Regionale n. 17 of November 24, 2001 regulates “strutture ricettive extralberghiere”. You should refer to article 1 to see different definitions and find out which your rental may match with.

Particularly relevant may be the definition of “case e appartamenti per vacanze” : “Sono case e appartamenti per vacanze le case e gli appartamenti dati in locazione ai turisti, senza la prestazione di alcun servizio di tipo alberghiero, ma con obbligo di recapito referente ospiti, per una permanenza minima di tre giorni e massima di novanta giorni”.

Segnalazione Certificata di Inizio Attività

Tourist accommodations (whether strutture ricettive alberghiere or strutture ricettive non alberghiere) are required to notify the start, change or termination of their activity. In order to do so,   Segnalazione Certificata di Inizio Attività (SCIA) must be filled out and sent to the municipality. This procedure can be completed online. Requirements / Standards

Legge Regionale n. 17 of November 24, 2001 (as amended by leggi regionali n°24 of December 29, 2005 ; n°4 of March 15, 2011; n°16 of August 7, 2014 and n°22 of August 8, 2016) has set a certain number of requirements and minimum services to provide. For case e appartamenti per vacanze, refer to article 3 and annex B of Legge Regionale 24 novembre 2001, n. 17. For instance, the minimum superficy of the case or appartamenti must be at least 8sqm for each Guests and Hosts must maintain the case or appartamenti in good conditions and clean between each stay.

Every accommodation must respect city regulations, including without limitations, hygiene and health regulations and building regulations.  


Price communication (Comunicazione Prezzi)

Under legge regionale n°22 of 8 August 2016, Hosts must inform the Campania Region of the minimum and maximum prices of accommodation and services provided. In order to do so, “price reporting” and “price list” firms must be filled out and transmitted to the Campania region by email. Registration of Guests to the Police (registrazione degli ospiti)

Under the article 109 of TULPS (Testo unico delle leggi di pubblica sicurezza), the operators of tourist accommodations (including short-term rentals) have the duty to transmit to the authorities informations about the public hosted. It must be done within 24 hours after the arrival of the Guests : the process can be completed online through the official portal of the State Police.

Stay Tax (imposta di soggiorno)

By council deliberation of June 12, 2012, the City Council of Napoli levies a tax on overnight stays, in hotel and non-hotel accommodations. It is paid per person (older than 18 yo) and per night, up to a maximum of 10 consecutive nights. For case e appartamenti per vacanze, the rate of the tax is 1,50 €. The tax is paid by Guests, but collected by Hosts and remitted to the City.
