The Lombardia Region has passed Legge Regionale 1 ottobre 2015 n. 27, in order to regulate tourist accommodations.

 

Definition

The Law divides the tourist accommodation in 2 groups : hotel (strutture ricettive alberghiere) or non-hotel accommodation (strutture ricettive non alberghiere). In the last one, we can find different types of accommodations that may fit your rental.

According to article 26 of the regional law, case e appartamento per vacanze are defined as “le strutture ricettive gestite in modo unitario e organizzate per fornire alloggio e eventualmente servizi complementari, in unità abitative, o parti di esse, con destinazione residenziale, composte da uno o più locali arredati e dotati di servizi igienici e di cucina e collocate in un unico complesso o in più complessi immobiliari”. It concerns every kind of residential unit, with one or more rooms and equipped with a kitchen and toilets. It can be let in part or as a whole, to provide lodging and possibly complementary services.

 

Communication

Tourist accommodations (whether strutture ricettive alberghiere or strutture ricettive non alberghiere) are required to notify the start, change or termination of their activity. In order to do so,  Segnalazione Certificata di Inizio Attività (SCIA) must be filled in and sent to the municipality. For more information, see this page.

Under article 38.1 of the regional law previously mentioned, Hosts that owned 3 case e appartamenti per vacanze or less are only required to submit a prior communication (a simplified form of SCIA) to the municipality of location. Insurance

It is mandatory to maintain a civil liability insurance, commensurate with the capacity of the accommodation.

 

Occupancy standards and requirements

Like article 27.3 of the regional law precises it, the case e appartamenti per vacanze must respect occupancy, safety and health standards. You can find the relevant national, regional and milanese regulations  on this portal.

The Regional Government of Lombardia has passed regolamento regionale 5 agosto 2016 n°7 to detail the minimum requirements that must be met in strutture ricettive non alberghiere (including  locazione per finalità turistiche under legge 9 dicembre 1998, n. 431 and case e appartamento per vacanze). We encourage our Hosts to refer to this regulation (especially Annex B).

 

Registration of Guests to the Police (registrazione degli ospiti)

Under the article 109 of TULPS (Testo unico delle leggi di pubblica sicurezza), the operators of tourist accommodations (including short-term rentals) have the duty to transmit informations about the guests to the authorities. It must be done within 24 hours after the arrival of the Guests : the process can be completed online through the official portal of the State Police.

Tourist Tax (tassa di soggiorno)

The tax must be paid by everyone staying in tourist accommodations : 2 € by night for a maximum period of 14 consecutive nights. It is the duty of the Hosts to collect it and remit it to the milanese authorities. The remittance can be completed online.
